Terms and Conditions

  1. Definitions and Interpretation

  • Bonus Points means the Points earned as a result of specific promotional or incentive programs expressly offered with Points. The Points are earned from a tier system, as follows:

    • Spend $250 and Receive $50 in points
    • Spend $500 and Receive $100 in points
    • Spend $1000 and Receive $200 in points
    • Spend $1500 and Receive $300 in points
    • Spend $2000 and Receive $400 in points
    • Spend $2500 and Receive $500 in points
    • Spend $3000 and Receive $600 in points
    • Spend $3500 and Receive $700 in points
    • Spend $4000 and Receive $800 in points
    • Spend $4500 and Receive $900 in points
    • Spend $5000 and Receive $1000 in points
    • Spend $10000 and Receive $2000 in points

 

  • Account means the stated and associated benefits of being a customer account of the Sydney Tools Points Program.
  • Account Holder means an individual or legal entity who has applied for an account in accordance with the Terms and Conditions , whose customer account number has been accepted by a Sydney Tools Store or Sydney Tools Online.

  • Privacy Act means the Privacy Act 1988 (Cth)

  • Privacy Policy means the Sydney Tools Privacy Policy published on the Sydney Tools website

  • Points refer to monetary Points given to Account Holders as a consequence of purchasing behaviours, incentives and/or promotions. Account Holders are notified of Points via email and on invoices.

  • Sydney Tools means Sydney Tools Pty Ltd, ABN 19 112 852 285.

  • Terms and Conditions means the Terms and Conditions applicable to Sydney Tools Points Program as set out in this document, as may be amended from time to time.

  • References to dollar amounts are in Australian currency. All prices quoted in member communications include GST.

2. Who can become an Account Holder:

  • Sydney Tools Points Program is a ("Program") managed and conducted by Sydney Tools Pty Ltd ABN 19 112 852 285. In consideration of Sydney Tools registering you as an Account Holder of the Program, you agree to be bound by the following Terms and Conditions which apply to all Account Holders of the Program. You are automatically an Account Holders if you have a customer account in store or customer account online and are bound by these Terms and Conditions.

Account Holder Eligibility

    • Account Holder is open to a corporation, firm, partnership or any other legal entity.

    • Sydney Tools reserves the right to decline an Account should they believe that the details provided are unauthorised, fraudulent or otherwise unlawful.

    • An eligible individual may apply for an Account by signing up and creating a customer account online at www.sydneytools.com.au or at any Sydney Tools store (including all required information).

    • Sydney Tools reserve the right to not accept or to reject an application for an Account at its absolute discretion.

    • All Account Holders will be assigned a customer account number which will be used for identification purposes.

    • By using your Account you agree to the collection, use and disclosure of your personal information in accordance with the Privacy Policy, as amended from time to time.

Transfer of Account

    • Accounts are not transferable.

Acceptance of the Terms and Conditions

    • These Terms and Conditions will form a contract between the Account Holder and Sydney Tools. The Account Holder is deemed to have accepted these Terms and Conditions upon signing up with a customer account on Sydney Tools online or a customer account at a Sydney Tools Store.

Notice

    • We will use our best efforts to notify you of any material changes to your Account and these Terms and Conditions by provide notice in advance via The Sydney Tools website or can be obtained by emailing info@sydneytools.com.au

Cancellation

    • An Account Holder may at any time cancel his or her Account by emailing info@sydneytools.com.au requesting cancellation of your Account.

3. How can I earn Points?

  • An Account Holder will earn Points once a tier has been reached.

    • Spend $250 and Receive $50 in points
    • Spend $500 and Receive $100 in points
    • Spend $1000 and Receive $200 in points
    • Spend $1500 and Receive $300 in points
    • Spend $2000 and Receive $400 in points
    • Spend $2500 and Receive $500 in points
    • Spend $3000 and Receive $600 in points
    • Spend $3500 and Receive $700 in points
    • Spend $4000 and Receive $800 in points
    • Spend $4500 and Receive $900 in points
    • Spend $5000 and Receive $1000 in points
    • Spend $10000 and Receive $2000 in points 
  • Bonus Points are awarded only by the particular amount specified above as each tier is achieved - even though a promotion might state that there is a 20% cashback, this does not mean that the value of the Bonus Points awarded is 20% of the invoice total, but rather based on the bonus points tiered system that Sydney Tools advertises.

  • Upon the occurrence of an Eligible Transaction, Points will be automatically added to the Account Holders Points balance. Points will be available in the relevant Account instantly after the purchase is complete.
  • Bonus points are earned on purchases even when Points or gift cards have been used for part of the transaction but Bonus Points will only be earned on the amounts paid over and above the total amount paid with Points and/or gift cards.

Where Points cannot be earned

    • An item advertised in a concurrent promotion at a reduced sale price or with a bonus will be excluded from accumulating Bonus Points.

    • Points cannot be earned on gift cards, selected non-stock items, Lay-Bys, Purchases where Points have been redeemed or repairs.

    • Exclusions: Bonus points do not apply for non-stock items, items on Sale with concurrent promotional price reductions, clearance items, and the following brands; Air BP, Festool, Fein, Pilot Air, Powers, PlumBoss, Radiodetection, Speed Gas, Wagner, Yamaha.

    • The following products are not eligible for any DeWalt (SBD) promotion (bonuses, redemptions etc) or supplier event (Roadshows etc): Generators, Pressure Washers, Protective Workwear (ie Gloves, Boots, Ear Muffs & Plugs, Trousers, Shorts, Safety Glasses) and Exclusive Sydney Tools Vacuums & related Vacuum Accessories.

    • Products eligible for bonus points will be advertised online with a "Bonus Points Banner" located on the product listing.
  •  
    • Points can not be accrued if invoices are price matched against a competitor.
  •  
    • Points are not transferable or redeemable for cash and will only automatically accrue to the Account.
  •  
    • Bonus points cannot be accumulated across multiple promotions. If multiple promotions are running simultaneously, customers will only receive bonus points for one qualifying promotion per transaction.
    • Resellers are not eligible for points.

Where Bonus Points Can Not Be Used?

    • Bonus points can not be applied to products that already offer a promotion, discounted price, price drop, price matched against a competitor, non-stocked items, or items that are a part of a layby.
    • Bonus Points are not permitted to be used on Festool or Fein, items.

How can I redeem my points?

    • There is no minimum number of Points required before you can redeem. Redemptions can be made in increments of cents.

    • All redemptions for Bonus Points will be processed directly at the Sydney Tools Store or Sydney Tools Online.

    • You can appeal to have any expired points reinstated by emailing order@sydneytools.com.au or submitting a feedback form https://sydneytools.com.au/p/feedback

Where can I redeem my points?

    • Bonus points accrued for purchases made at Sydney Tools online can be redeemed at Sydney Tools online only.

    • Bonus points accrued for purchases made at a Sydney Tools Store can be redeemed at any Sydney Tools store.

How are Points calculated

    • Points can only be redeemed in a Sydney Tools Store and presentation of identification is required unless stated otherwise.

    • Points based Promotions may include specific offer terms and conditions, including expiry dates. These Terms and Conditions are to be read in conjunction with any additional conditions associated with Points.

    • All Points have an expiry date as outlined in each specific sales event, at which point they will no longer be available. You may appeal to have expired points reinstated by emailing order@sydneytools.com.au

    • Only Points from one Account can be presented per transaction.

    • Bonus points are capped after our last tier - Spend $10,000 and receive $2,000 points. Any invoices larger than this will not receive more than $2,000 points.

When will the points expire?

    • Points expiry dates are subject to vary for each specific sale event, the expiry dates will be outlined in all promotional materia at each specific sale event.

    • Points will typically expire 3 years after the date of last Eligible Transaction unless otherwise specified.

    • Supplier Roadshows points will expire 3 years after the date of last Eligible Transaction.

Returns and Exchanges

    • Any returns of items used to earn Points will cause a deduction of the points earned during the original purchase. If you have redeemed your points before returning the product, you will be refunded the purchase value minus the equivalent monetary value of the Points (to the nearest dollar) used in the original transaction.

    • Refund or exchange of redeemed items will only be provided in accordance with the Sydney Tools Customer Friendly Refund Policy, please see https://sydneytools.com.au/p/returns-refunds-repairs for more details.

    • If a redeemed item is returned because it is faulty, a Sydney Tools store will need to assess whether the fault is a major or minor fault and will organise an appropriate remedy. Please note, if necessary, products may be sent to the manufacturer for assessment to determine if they are faulty.

    • The time frame for any exchange or refund is at the discretion of the Sydney Tools Store.

4. Indemnity

  • The Account Holder indemnifies Sydney Tools in relation to any claim against Sydney Tools and for any liability or loss suffered by Sydney Tools or arising from or in connection with these Terms and Conditions.

5. Limitation of Liability

  • To the extent permitted by law, Sydney Tools is not liable for any Points and/or benefits not being available for any reason whatsoever. In addition, and without limiting the foregoing, to the extent permitted by law Sydney Tools, is not liable for a Member’s failure to notify the Sydney Tools Store of their Membership and entitlement to Points.

  • If any services provided to a Member by Sydney Tools or the Sydney Tools Store under these Terms and Conditions are within the scope of the Australian Consumer Law set out in Schedule Two of the Competition and Consumer Act 2010 (Cth) (“ACL”) then, subject to the provisions of the ACL, a number of guarantees will apply in respect of the services under the ACL including:

  • The services being rendered with due care and skill;

  • The services being fit for the purpose for which the services are being acquired, any disclosed purpose or being capable of achieving any disclosed result; and

  • The services being supplied within a reasonable time.

  • Sydney Tools do not offer any other guarantees other than those contained in the consumer guarantee provisions of the ACL.

Sydney Tools and any of their officers, employees or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits), arising under or in connection with these Terms and Conditions or the Program including, without limitation, any changes to the Terms and Conditions or the Program, save to the extent that such loss or claim arises from the negligence or wilful misconduct of Sydney Tools or a Sydney Tools Store, or any of their officers, employees or agents.

6. How will Sydney Tools be collecting, using and disclosing my personal information?

  • Sydney Tools understand the importance of the privacy of an individual’s personal information. Sydney Tools may collect and use personal information for the purpose of providing members with access to our business activities, including our promotional activities and administering your Account and involvement in the Program, or as required by law.

  • We collect, use and disclose your personal information in accordance with the Points Program Privacy Policy ("Privacy Policy"), which forms part of these Terms and Conditions. Sydney Tools may amend the terms of the Privacy Policy from time to time in accordance with these Terms and Conditions. In handling personal information, Sydney Tools and the Sydney Tools Store will comply with the Privacy Act.

  • By registering as an Account Holder or by using your Account benefits, you acknowledge that you have read the Privacy Policy, and understand and agree that we will collect, use, store and disclose your personal information in accordance with its terms, as amended from time to time.
